Is California Poised to Legalize Sports Betting?
In recent discussions about which states might next legalize sports betting, California has emerged as a front-runner. Despite previous failed attempts, including the notably expensive ballot propositions Prop 27 and Prop 26 six years ago, the landscape seems to be changing. In these earlier initiatives, hefty opposition was faced due to conflicts between tribal Indian gaming associations and major sportsbooks such as FanDuel and DraftKings.
The failed propositions cost over $400 million, making it the most expensive ballot proposition campaign in U.S. history, yet they only garnered around 16% of the vote. Historically, tribal associations wielding substantial lobbying power have been pivotal. Their opposition or demand to host sports betting under their terms was a major hurdle. Recently, however, a shift appears imminent.
James Siva, chair of the California Nation's Indian Gaming Association, indicated at a recent conference that the proliferation of sports prediction markets, which impact potential tax revenues, might be driving tribes to reconsider their stance. These markets have grown significantly, now featuring players like FanDuel and DraftKings, and are dipping into profits that tribes could have capitalized on had they facilitated sports betting. Consequently, there is now a greater incentive for tribes to back sports betting initiatives.
Siva suggested that new proposals are likely to be introduced for the 2028 ballot as this is the subsequent opportunity under California law where such a measure could be passed. This timeline marks an interesting pivot point but underscores that any new developments are still a few years away. The rapidly changing dynamics in betting markets and ongoing negotiations between multiple stakeholders hint that the path to legalization is complex but feasible.
