Legality of Sports Betting in Tennessee?

In terms of the legality of sports betting in Tennessee, when the Professional and Amateur Sports Protection Act (PASPA) of 1992 was overturned in 2018, lawmakers started making plans to bring sports betting to Tennessee. 

At the start of 2019, Tennessee legislators introduced House Bill 1 that was aimed to legalize online sports betting in the state. This was a contrast from other states in the country, which would require bettors to register for accounts at retail sportsbooks or casinos in their state. With a focus on online and mobile sports betting, Tennessee made this decision because the state does not have any brick-and-mortar casinos. 

Initially, House Bill 1 faced opposition with concerns in the state for the social impact and the lack of oversight that was at the time not in place. Even still, the bill would later pass both the Tennessee House and Senate, and on May 24, 2019 Governor Bill Lee pushed the bill through. 

What would become known as the Sports Gaming Act would eventually be linked with the Tennessee Education Lottery Corporation (TELC) who would be required to oversee and regulate the state’s sports betting industry. Over the years that would follow, the TELC developed a comprehensive plan for sports betting in the state, including plans for operator licensing, responsible gaming resources, and taxes.

On top of taxes, the Sports Gaming Act put forth a 10% minimum hold on all wagers, which is higher than most states in the country. As a result, the income would start following the state’s general budget and educational fund. On November 1, 2020, the plans were complete, as sports betting officially went live with BetMGM, DraftKings, FanDuel, and Action 24/7 being the first four Tennessee sportsbooks to officially go live.
